Terms of Service
This Terms of Service is published by LIMINGX GLOBAL INC., trading as Drip & Ember, and applies to orders placed through our storefront. We keep this under review and will post any change here.
Effective date: the date this policy is published on our storefront. If we revise it, the new version takes effect the day it appears there. Any notice under this section may be given by email or through our storefront.
These terms
These terms govern your use of this storefront and any order you place through it. By browsing, creating an account or completing a checkout, you accept them. If you do not, the store is still here — you simply should not order from it. Each provision answers a question that has actually been raised.
Who may order
You may order if you can form a binding contract where you live. If you are below that age, an adult must place and pay for the order, and any warranty claim runs through them. The buyer must be old enough to form a contract where they live.
You are responsible for the accuracy of the information you give us — an address that is wrong at checkout will produce a parcel that cannot be delivered, and the second postage is chargeable. The details entered at checkout are the ones acted on.
When an order is accepted
An order is an offer, and it is accepted when we send a dispatch notice, not when the checkout confirms payment. Until then the order may be declined — because an item turned out to be out of stock, because a price was misstated, or because the transaction failed a fraud check. If we decline, any payment taken is refunded in full. Acceptance happens at dispatch, not at payment confirmation.
Where an item sells out between your order and dispatch, we will tell you and offer either a wait or a refund. We will not substitute a different piece without asking. An order may be declined where stock has run out or a price was misstated.
Prices, tax and currency
Prices are shown in the currency selected on the storefront and are exclusive of any import duty or local tax charged on arrival, except where the checkout states otherwise. We may change a price at any time, but a change never applies to an order already accepted. The amount confirmed at checkout is the one that applies to your order.
Where sales tax applies to your order it is calculated at checkout from your delivery address and shown as a separate line before payment. If it is not shown, none has been collected by us and any tax owed at import is the recipient's responsibility. Import duty charged on arrival is separate from the price paid.
If a price is displayed in error — a decimal in the wrong place, a variant priced as another — we may cancel the order and refund it rather than honour the error. We will tell you rather than quietly back-order it. A price change never applies retroactively to an accepted order.
Payment
Payment is taken at checkout by card or by any other method shown there. The transaction is processed by a third-party provider; we do not receive or store the full card number. Card details are held by the payment provider, never by us.
Payments on this store are processed by Shopify Payments. A declined authorisation stops the order until it is resolved.
If a payment is declined or later reversed, we may suspend the order until it is resolved. Where a chargeback is raised without contacting us first, we will respond with the order record, the tracking and the delivery confirmation. A chargeback raised without contacting us first is answered with the delivery record.
Cancelling or changing an order
You can cancel before dispatch, and we will refund in full. After dispatch the order is in the carrier's hands and the return policy applies instead. Address changes are possible until the label is generated and are often impossible afterwards. Before the label is generated, almost any change is possible.
We may also cancel an order where stock has run out, where a pricing error has occurred, or where we suspect fraud. In each case the refund is full and is issued without being asked for. After dispatch the return process applies instead.
Content, images and intellectual property
The text, photography, product names and design of this storefront belong to Drip & Ember or are licensed to it. You may view, download and print pages for your own use in deciding whether to buy. You may not republish them, use them to train a model, or present them as your own. Personal, non-commercial use of the pages is permitted.
If you send us a photograph, a review or a message, you keep ownership of it and grant us permission to use it in connection with the order and, where you agree, in our own marketing. Withdrawing that permission is a message away and is actioned promptly. Short quotations with a link are welcome.
Permitted use of this store
You are granted a limited, revocable licence to access this storefront for the purpose of shopping. It does not include the right to resell our goods as a business, to reproduce the store, or to use our name in a way that suggests an endorsement you do not have. The licence is personal, non-exclusive and revocable.
Prohibited conduct
The storefront is a shop, not a platform. The conduct below is prohibited because it breaks the store, defrauds another customer, or breaks the law. A breach ends the licence to use the store.
- Attacking the site: scanning, flooding, scraping coffee piece listings at scale, injecting code.
- Testing stolen cards through the drippers, kettles and serving ware checkout. This is reported, not merely blocked.
- Ordering drippers, kettles and serving ware in someone else's name, or opening an account with another person's details.
- Abuse of the people answering your drippers, kettles and serving ware messages, including threats or unlawful content.
- Defeating a control: obtaining drippers, kettles and serving ware unpaid, reusing a one-use code, bypassing a regional restriction.
- Copying the drippers, kettles and serving ware site or the brand for commercial gain, including a lookalike domain.
Where conduct on this list is detected, we may refuse the order, close the account and, where a law has been broken, report it. Existing orders will be refunded rather than fulfilled. Automated traffic from a search engine is not interference.
Links and third-party services
This storefront links to, and relies on, services run by other companies — payment, delivery tracking, and occasionally a journal or a social profile. Those services have their own terms, and we are not responsible for them. Each linked service carries its own terms.
Disclaimer
This storefront is provided as it is. We work to keep descriptions, prices and stock accurate, but we do not warrant that the site will be uninterrupted or free of error. Product photography is representative; natural materials vary from piece to piece, and that variation is a feature rather than a defect. Photography is representative rather than exact for natural materials.
Nothing on this storefront is professional advice. Care guidance is provided to help a piece last, not as a substitute for the manufacturer's instructions where one supplies them. Care guidance is practical advice, not a guarantee against wear.
Limitation of liability
To the extent the law allows, our liability for any claim connected with an order is limited to the amount you paid for that order. We are not liable for indirect losses — lost profit, lost opportunity or consequential damage — and nothing in these terms limits liability for death, personal injury or fraud, which cannot be limited. The cap is the value of the order concerned.
Indemnity
You agree to cover us against claims, losses and reasonable legal costs arising from your breach of these terms — most obviously from fraud, from unlawful conduct, or from a claim that content you sent us infringes someone else's rights. It is not aimed at an ordinary complaint.
Suspension and termination
We may suspend or close an account where these terms are broken, where fraud is suspected, or where we are required to by law. Where an order has been paid for and not yet dispatched, it is refunded rather than fulfilled. You may stop using the store at any time, and may ask for your account to be closed. Paid but unshipped orders are refunded rather than fulfilled.
Governing law and disputes
These terms are governed by the law of the place where we are established, and any dispute will be heard by the courts that have jurisdiction there. That does not remove any right you have to bring a claim before the courts of your own country of residence where consumer law grants it. A message to us is the first step before any proceedings.
Before either side starts proceedings, we ask for one exchange of messages. A written complaint resolves nearly everything, and it is far cheaper than the alternative for both of us. Nothing here removes a right to sue in your own country of residence.
Changes to these terms
We may revise these terms. The version in force is the one published here when your order was accepted, and a later revision does not apply to an order already accepted. The version in force is the one published when the order was accepted.
Severability and waiver
If any part of these terms is found unenforceable, the rest continues in force and the unenforceable part is read down to the minimum the law permits. Our failure to enforce a term on one occasion is not a waiver of it. The remainder of the terms continues in force.
The whole agreement
These terms, together with the privacy, refund and shipping policies published on this storefront, are the whole agreement between us. They replace anything said informally, whether by message, on the phone or in person. The published policies together form the whole agreement.
